Reform on Social Dialogue in Luxembourg

The Law of 23 July 2015, concerning the reform of social dialogue within companies, came into force on 1 January 2016. The law aims to enhance the role of employee delegations within companies.

 


 

Key Provision: Art. L. 412-2 of the Labour Code

 

The law amends Article L. 412-2 of the Labour Code as follows:

 

(3) "The delegation may decide to appoint an external expert when it considers that the issue is crucial for the company or the employees.
Unless otherwise agreed beforehand, the company’s financial liability is limited to one expert and cannot exceed, per social year and per expert, a percentage of the total annual payroll of the employees, as declared to the Joint Social Security Centre during the year preceding the decision on the mandate, to be determined by Grand Ducal Regulation.
The employer must be informed beforehand about the nature of the mandate granted."
